California Marine Invasive Species Program Update

 


BACKGROUND


As previously reported in several of our circulars the State of California continues to actively adopt additional regulations and amend existing requirements that affect the shipping industry calling State of California waters and ports.  The latest amendments have come from the California State Lands Commission (CSLC) which manages the Marine Invasive Species Program in the State of California.
 
The CSLC has amended regulations to increase the Marine Invasive Species Control Fund Fee from $625 to $850 per voyage effective November 1, 2009 as per Title 2, Division 3, Chapter 1 Article 4.5 Marine Invasive Species Control Fund Fee.  
 
The CSCL also recently provided a letter to shipping agents announcing the adoption of amendments to State of California regulations Title 2, Division 3, Chapter 1 Article 4.7 Performance Standards for the Discharge of Ballast Water For Vessels Operating in California Waters.  The recently adopted discharge standards are found in the table below:

Please note that these regulations go into effect on January 1, 2010 as per the prescribed implementation schedule below:

APPLICABILITY

  • All vessels calling/operating in State of California waters
  • This does not apply to vessels that do not call the State of California waters

ACTIONS TO BE TAKEN

  • All vessels calling/operating in State of California waters should continue to arrange payment of the increased Marine Invasive Species Control Fund Fee of $850 per voyage via your local vessel agent.
  • All owner/operators of vessels calling/operating in State of California waters should also make preparations for their fleet vessels to meet the California Ballast Water Performance Discharge Standards in accordance with the implementation schedule as appropriate.
