New California On-Water Response Requirements for Santa Barbara Channel, Port Hueneme and HVP OPRAs

 


BACKGROUND


As reported in our Circular 016-09 the State of California has been very active in adopting additional regulations and requirements that affect vessels calling certain State of California waters and ports.  The State of California Office of Spill Prevention and Response (OSPR) sent a letter to all California Marine Oil Spill Contingency Plan Holders on August 10, 2009 advising of these new on-water response requirements.
 
The increased response planning requirements affect vessels that call Port Hueneme, that transit the southbound traffic lane in the Santa Barbara Channel or that transit the area south of the San Mateo Bridge while en route to Redwood City in southern San Francisco Bay.  These increased response planning requirements became effective on July 1, 2009 and enforcement commenced on October 1, 2009.
 
APPLICABILITY

  • All Plan Holders who have vessels that call Port Hueneme, that transit the southbound traffic lane in the Santa Barbara Channel or that transit the area south of  the San Mateo Bridge while en route to Redwood City in southern San Francisco Bay must obtain the required additional OSRO coverage to comply with the new regulations being enforced starting October 1, 2009. 

OSRO SERVICE PROVIDERS OFFER ADDITIONAL COVERAGE

O'Brien'sRM has been in contact with the two nation-wide OSRO service providers, Marine Spill Response Corporation (MSRC) and National Response Corporation (NRC) regarding their abilities to make the necessary response equipment available for vessels to come into compliance with these new regulations. 

  • MSRC did not apply to OSPR to revise their OSRO classification application, but are able and willing to provide the additional required coverage on a per voyage basis in accordance with the MSRC Service Agreement Schedule 3

ACTIONS TO BE TAKEN

  • Plan Holders who have vessels that call/transit the areas mentioned above will need to make arrangements with their contracted OSRO service providers in order to obtain the required additional coverage not already included in their contracts.  The additional coverage should be arranged directly with the service provider on a per voyage basis at least 24 hours before the coverage is needed.

  • Please note that these new regulations do NOT require a revision to the California Vessel Contingency Plan nor the Federal Vessel Response Plan.
